Terms of Use & Purchase

These Terms govern your access to and use of Buy Avanta and purchases made through the platform.

By creating an account, placing an order, or otherwise accepting these Terms, you agree to them and acknowledge our Privacy Policy.

Buy Avanta is operated by The Avanta Company LLC.

Buy Avanta provides a technology-enabled cross-border shopping service that allows customers to discover, purchase, and receive eligible products.

Products may be sourced from third-party retailers, distributors, or suppliers after you submit an order.

Your customer relationship and transaction through the Buy Avanta platform are governed by these Terms.

You must:

• be at least 18 years old;
• have legal capacity to enter into a contract;
• provide accurate information;
• use a payment method you are authorized to use.

You are responsible for:

• providing accurate account information;
• protecting your credentials;
• activity occurring through your account;
• promptly notifying us of suspected unauthorized access.

We may restrict an account where reasonably necessary for security, fraud prevention, legal compliance, or abuse prevention.

We work to provide accurate product:

• titles;
• images;
• prices;
• sizes;
• specifications;
• availability;
• compatibility information.

However, third-party product information may change or contain errors.

Where material information cannot be verified, we may:

• place the product on hold;
• request clarification;
• cancel the affected item;
• offer another option only with your approval.

The price displayed on Buy Avanta is the Buy Avanta customer price unless otherwise stated.

Supplier MSRP, third-party retailer pricing, or internal market observations do not themselves constitute your purchase price.

Prices may change before the underlying item is purchased.

No silent price increases

If an authoritative price increase requires you to pay more than the amount you approved, Buy Avanta will not silently purchase the item at the higher price.

We may ask you to:

• approve the revised price;
• choose another option;
• remove the item.

Promotional claims displayed by Buy Avanta are subject to their stated conditions and availability.

We do not guarantee that a third-party promotion will remain available until procurement is completed.

Where a promotion expires before purchase, the price-change rules above apply.

Availability may change after you place an order.

An order confirmation does not necessarily mean that a third-party retailer or supplier has reserved inventory.

If an item becomes unavailable, we may:

• cancel and refund the affected item;
• ask whether you want another option;
• offer a substitute only with your explicit approval.

Buy Avanta does not silently substitute materially different products.

Where a substitution is proposed, you must approve the specific alternative before Buy Avanta proceeds.

You authorize Buy Avanta and its payment providers to charge the amounts presented and approved at checkout.

Payments may be processed through third-party payment providers.

Buy Avanta does not need your full card number or security code stored in its own database to process an order. The existing architecture is expressly designed around provider-hosted/tokenized payment handling.

Orders may be subject to:

• payment verification;
• fraud review;
• inventory validation;
• product eligibility;
• price verification;
• shipping eligibility;
• regulatory review.

A payment being successfully authorized does not require Buy Avanta to proceed with a transaction that fails an applicable safety, fraud, legal, or product-control requirement.

Shipping options, charges, and estimated timelines are presented according to Buy Avanta's current Shipping & Delivery Policy.

Delivery times are estimates unless expressly guaranteed.

Shipping to Ghana includes applicable Ghana customs, taxes and normal clearance for eligible orders. Customers are not normally required to pay a separate Avanta customs, duty or clearance charge when an eligible order arrives in Ghana.

Avanta collects nothing for Ghana final-mile delivery: customers enjoy free pickup at the Avanta Ghana Hub. If you choose courier delivery, you pay the local courier directly; that courier payment is separate from Avanta's Shipping to Ghana charge and is not a customs, duty or clearance charge.

Cross-border transportation may be affected by:

• carriers;
• customs;
• government inspections;
• weather;
• security events;
• regulatory requirements;
• other circumstances beyond Buy Avanta's reasonable control.

International purchases may be subject to customs duties, taxes, levies, documentation, or governmental assessments.

The treatment of those amounts is governed by the Shipping & Delivery Policy and the information presented for the applicable order.

Government assessments may differ from preliminary estimates.

Buy Avanta will not intentionally hide known material charges that are part of the approved checkout total.

Returns, cancellations and refunds are governed by Buy Avanta's current Returns, Cancellations & Refunds Policy.

Cross-border returns may be affected by:

• retailer or supplier eligibility;
• item condition;
• shipping cost;
• regulatory restrictions;
• product category;
• timing.

Buy Avanta cannot promise a refund from an underlying retailer or supplier where that return is not actually available.

If you receive:

• a damaged item;
• the wrong item;
• a missing item;
• an incorrect quantity;
• a product with a suspected authenticity issue;

contact Buy Avanta promptly and provide requested evidence.

We will evaluate the claim under the applicable Returns Policy.

Some products may be restricted or prohibited for:

• purchase;
• international transportation;
• import into Ghana;
• delivery;
• customer use.

Buy Avanta may refuse or cancel a restricted product even after it appears in search results.

Automotive product information may include vehicle compatibility information.

You are responsible for providing accurate vehicle information.

Buy Avanta will only present definitive compatibility claims where our approved fitment controls support them.

Where compatibility is uncertain, we may ask you to verify vehicle details before purchase.

You should not install or use a part you believe is incompatible.

Sika is Buy Avanta's shopping assistant.

Sika can help you:

• find products;
• narrow choices;
• interpret shopping requests;
• identify potentially relevant options.

Sika does not independently control:

• final price;
• inventory;
• vehicle compatibility;
• shipping;
• payment;
• purchase authorization.

Those matters are validated through Buy Avanta's systems.

Third-party retailer, supplier, manufacturer, and brand names belong to their respective owners.

Unless expressly stated, reference to a retailer, brand, or supplier does not imply sponsorship, endorsement, affiliation, or authorization by that company.

If Buy Avanta offers paid concierge services, applicable fees and material terms will be shown before you approve the request.

Concierge fees do not necessarily include product, shipping, tax, or other charges unless expressly stated.

If paid membership is enabled, Buy Avanta will disclose before enrollment:

• price;
• billing frequency;
• whether it renews automatically;
• renewal timing;
• cancellation process;
• material benefits.

Do not interpret membership marketing as a guarantee that every order will produce savings.

You may not use Buy Avanta to:

• commit fraud;
• use unauthorized payment methods;
• bypass product restrictions;
• attack or disrupt our systems;
• scrape protected content at scale without authorization;
• access another person's account;
• abuse refund or chargeback processes;
• violate applicable law.

Buy Avanta's branding, software, design, original content, and proprietary systems are owned by or licensed to The Avanta Company LLC.

Third-party trademarks remain the property of their respective owners.

We may maintain, modify, suspend, restrict, or discontinue features where reasonably necessary.

We do not guarantee uninterrupted access at all times.

To the maximum extent permitted by applicable law, Buy Avanta provides the platform and services subject to reasonable operational limitations.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

Manufacturer warranties, where applicable, remain subject to their own terms.

To the maximum extent permitted by law, The Avanta Company LLC will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the service.

Any limitation of liability is subject to rights that applicable consumer law does not allow us to exclude.

The governing law, venue, and dispute-resolution framework for these Terms will be confirmed and published here before launch following legal review, including consideration of Ghana consumer-law implications and cross-border enforcement.

Material changes will receive:

• a new version;
• an effective date;
• appropriate notice;
• re-acceptance where legally or operationally required.

Buy Avanta preserves historical Terms versions rather than overwriting them.
